摘要
连累犯是事前与他人没有通谋,明知他人的犯罪行为或性质而事后故意提供帮助的人。连累犯中的"明知"是清楚、明白地知悉事前犯罪人的行为或性质,而总则中的"明知"是犯罪人承担刑事责任的标准。无论是本犯揭发连累犯的罪行还是连累犯揭发本犯的犯罪行为均有成立立功的空间。当连累犯自首的同时又符合立功条件,应认定为自首并且优先考虑减轻处罚。
Criminal of incrimination is made in advance without conspires with others, knowing that the crimes of others or property and then deliberately provide help to others. The purpose of criminals in the'knowledge'is clear,clearly aware of prior criminal conduct or property,and the'knowledge'in general is the standard of criminal taking responsibility of penalty. Whether who committed crimes exposes the involved offender or on the contrary is likely to make contributions. When the involved offender meets the requirements of surrender and making contributions at the same time, should be deemed to surrender and apply mitigated punishment in priority.
