摘要
2012年修订的《中华人民共和国民事诉讼法》增设了第三人撤销之诉制度,意在遏制司法实践中频现的恶意诉讼和虚假诉讼,加强对民事诉讼过程中案外第三人合法权益的保护。第三人撤销之诉与案外人执行异议之诉、案外人申请再审之诉等制度为民事诉讼活动中权益受损的案外第三人提供了多元化的维权救济途径。但是,我国第三人撤销之诉的相关规定较为简单,尤其是与案外人执行异议之诉的关系不甚清晰。
The amendment in 2012 to the Civil Procedure Law of the People's Republic of China adds an article that al-lows a third party to take a revocatory action,intending to curb malicious and false lawsuits occurring frequently in thejudicial practice and to protect the legitimate rights and interests of the third party outside a case of civil proceedings.Such mechanisms as the third party's revocatory action and the outsider's execution objection as well as the outsider'sapplication for reexamination provide a diversified relief and protection approaches for the third party whose interestsmight be damaged in the civil litigation activities. However,the provision concerning the third party's revocatory actionis relatively simple,especially the relationship between the third party's revocatory action and the outsider's executionobjection is not clear. This paper intends to address these problems.
