摘要
国务院行政规定虽然在现实生活中发挥着重要作用,但在法律规范体系内却一直处于比较"隐蔽"的地位。在行政规范体系中,国务院行政规定的效力仅次于行政法规,高于部门规章、地方政府规章以及各种其他行政规定;在行政规范体系之外,国务院行政规定的效力低于法律和地方性法规、自治条例、单行条例。判断规范性文件的效力位阶存在"从行政等级出发"和"从表现形式出发"两种思路。应该逐步摆脱从行政等级出发确定行政机关制定规范的等级的思维惯性,正确定位国务院发布的行政规定的效力位阶,自觉区分行政法规和国务院行政规定的适用场合、调整对象。
The administrative provisions made by the State Council play an important role in social life, but cannot beeasily identified in the legal system. In administrative norm system, the legal effect of the provisions by the StateCouncil is next to that of the administrative codes by the State Council, but superior to those by the ministry, the localgovernment and other sorts. Outside administrative norm system, the legal effect of the administrative provisions areinferior to law, local rules, autonomous rules and separate rules. There are two ways to determine the legal effect of anormative document: from its admistrative rank and from its expressive form. We should get rid of the customarythinking of determining the rank of rule stipulation from the maker’s administrative rank, position appropriately thelegal effect of the provisions, and distinguish the application situations and adjustment objects of the administrativeprovisions and codes made by the State Council.
