摘要
文章从分析设置司法功能的目的入手,指出为达到解决纠纷、稳定社会的司法目的,首先要依靠司法公正。而作为实体公正的司法公正与作为程序公正的公正司法都有其不可克服的局限性。正是这些局限性成为导致司法不信任的口实,从而影响人们对司法判决的信从。克服这一局限性的一个有效途径就是树立和强化司法权威。我们必须正确认识制度权威、法律权威与法院权威、法官权威之间的关系,实现司法公正、司法公信力和司法权威之间的良性互动,以确保司法目的的实现。
In order to fulfill the judiciary purpose of settling disputes and retaining social stability, judiciary justice should be authoritatively established. However, judiciary justice both as an institution and as a process has its inherent limitations, and these limitations lend excuse to distrust in the judicial system. This being the case, it is of paramount importance to establish and enhance the absolute authority of the judicial system.
