摘要
在人类刑法文明史上,量刑公正始终是人们不断追求的崇高目标。但在实践中,由于犯罪量刑情节较为复杂,其涉及不同的主体,经过诸多的环节,就很有可能会导致量刑结果和维护社会正义与司法公正的初衷相违背的现象。本文利用法经济学的分析方法,采用博弈均衡制度观的宏观视角,以经济学的数理化方法来研究量刑的各个环节,综合系统地分析公正量刑中的各个因素,以及达到公正量刑需要怎样的条件。通过分析量刑环节、犯罪决策环节,以及法制环境环节这三个过程各自及相互间的关系,得出了公正的量刑结果所需的一系列必要条件,并在此基础上提出了初步的政策建议。
In the history of human civilization,especially the one involved law justice,a fair sentence has always been the noble goal for pursuing.This paper is tries to give a new analysis of this law issue with an economic approach.With the institutional view of game equilibrium as a framework,this paper analyzes three domains of a sentence and their correlations in a comprehensive and systematic way.After establishing the logic foundation,we analyzed the sentencing,criminal decision-making,as well as legislation,and their mutual relations with a way of backward induction.Then,it reaches the conclusion that what is necessity to the balanced sentence is the balanced institution conditions.
