摘要
舆论监督是新闻媒体的重要职能之一。近些年来 ,随着我国民主与法制建设步伐的加快 ,舆论监督在我国政治经济社会生活中的作用越来越显著。但是 ,新闻官司也随之大量出现。这一方面反映了我国民主气氛的日渐浓厚和公民与组织法律意识的提高 ,另一方面也反映了我国舆论监督权滥用的严重程度及相关法制建设的落后。本文拟从舆论监督权的基本理念和实施现状出发 ,分析舆论监督权滥用的原因 ,进而从权利平衡的角度 ,提出要制约舆论监督权 。
The supervision of Public opinion is one of the important functions of the media. With the rapid development of our countrys democracy and legal system, the supervision of Public opinion has played more and more important role in our society in resent years. It reflects our countrys democracy atmosphere becomes better, and people and legal entities legal consciousness is improved. However, it also reflects some serious situations to supervise the public opinion and to construct the legal system. The thesis, based on the basic idea and current development of the analyses the causes and characters of public opinion supervision, arrive at the conclusion that in order to balance the public rights we must control the public opinion supervision and perfect relevant legislation.
