摘要
司法独立是我国司法改革的重要价值目标,是司法公正和公民权利保障的基础和前提。在依法治军和推进军事司法改革的背景下,军事司法机关依法独立行使职权有着更加特殊的意义。本文从此目标出发,尝试讨论军事司法的独立在现阶段军事司法改革中的必要性和实践障碍性因素,探讨司法的独立在我国军事司法领域适用的路径选择。
Judicial independence is one of the most important value goals of judicial reform in China. It is the foundation and prerequisite of legal justice and civil rights. In accordance w ith the policy of managing the armed forces by law and the purpose to promote the military judicial reform,it w ill be of more special significance if the military judicial officers discharge their duties independently according to law. W ith this aim in mind this paper tries to discuss the necessity of military judicial independence to legal reform as w ell as the obstacles in the present military situation. T his paper will also discuss the path choices of the practice of judicial independence in the field of military justice in C hina.
