摘要
长期以来,趋吉避凶是影响中国人选购住宅的重要因素。近年来,"凶宅"交易纠纷屡有发生,司法机关时有同案异判。"凶宅"的判定,既要考量房屋的客观情形,亦要顾及居住者的主观心理。出卖人负有"凶宅"信息披露义务,违反者构成欺诈。鉴于"凶宅"会冲击民众心理,造成房屋价值贬损,其应纳入物的瑕疵。买受人享有选择权,可通过合同撤销或解除路径维护合法权益。
For a long time,pursuing good future and avoiding disaster is the inherent thinking of the Chinese people to choose a house. In recent years,disputes have arisen in " haunted house" transactions,and the judiciary is different in the same case. The judgment of " haunted house" should comprehensively consider the objective situation of the house and the subjective psychology of the occupants. The owner of the house is obliged to disclose the information of the " haunted house". If there is any concealment,it constitutes fraud. " Haunted house" will impact the people 's psychology,resulting in a decline in house prices,and therefore constitute a paralysis. The parties have the right to choose whether to sue or release the contract.
