摘要
人体器官获取行为即尊重提供者意志与违背提供者意志两种主要行为方式。通过对自愿无偿、商业交易、违法犯罪、国家强制征收这四种获取行为方式所关涉的权益位阶进行深入地透视分析。在坚持尊重器官提供者意愿的前提下,并在生命健康权利实现、权利均衡保障、尊重生命伦理价值、公平效益均衡的关涉权益位阶理论和法理原则的制约下,提出化解人体器官获取行为利益冲突的建议。创制能最大限度地满足人体器官接受者的生命健康需求的法律制度和运作机制,保障器官来源渠道的合法、畅通,充分发挥人体器官移植造福人类的效益。

To create a legal system and0perating mechanism to meet the actual situation and to maximize the life and health needs of the human organ recipients, only in this way can the channels of organ source be guaranteed and unimpeded, and the benefit of human organ transplantation for the benefit of mankind is fully brought into play.
