摘要
要解决跨界公共问题,应当加强区域合作组织机制建设。对此,作为德国区域合作最重要组织机制的目的团体公法人可被借鉴,其组建模式、结构模式、行为模式与经费模式等制度设计应当被系统考察。以德国目的团体公法人为参照,设立目的型事业单位,可以有效解决我国在区域合作治理中所面临的组织机制匮乏困境。目前应当在宪法与法律的框架下,尝试对目的型事业单位进行管理体制的革新。改革的目标是增强我国区域合作组织机制的权威性与执行力。
In order to deal with cross-border issues, it is necessary to strengthen the organizational mechanism and redetermine the scope of responsibilities. The special purpose association is the most important organizational mechanism of local cooperation in Germany. The reason for the choice of the special purpose association and its specific designs, such as model of establishment, model of structure, model of behavior, model of revenue and expenditure, should become the key part of comparative law research. Taking German special purpose association as a reference model, the establishment of special purpose public institution in China could resolve the lack of the organizational mechanism of local cooperation. The experimental reform could be implemented within the framework of the constitutional law and the general Law. The purpose of this reform is to enhance the authority and enforcement of the organizational mechanism of local cooperation.
