摘要
从国家治理现代化的视域看,我国以往环境法治问题很多,迫切需要通过改革进行完善。政府、市场和社会组织之间,通过合作形成三螺旋型结构,是较为理想的环境治理模式,并成为环境法治变革的基础。未来我国环境法治在立法上,将向协同、协商的方向发展,环境软法的数量将越来越多;在执法上除传统行政手段外,社会组织参与环境法的执行,及市场化的环境法执行工具,将构成环境执法的另外两元;在司法上将不断实现现代化,环境司法的回应性、恢复性,以及协商对话性将显著增强;在守法上将既治民、更治官,通过督察法治化和公益诉讼,督促政府履行环境管理职责。这场变革就是要用法律形式,构建环境治理中的三元关系,发挥三者协同效应实现共治。
From the perspective of the modernization of national governance, China has had a lot of problems with the rule of law in the past, and it is urgent to improve it through reform. Through cooperation, the government, market and social organizations form a three-spiral structure, which is the ideal model of environmental governance and the basis for the change of environmental rule of law. In the future, the law of environmental law in China will develop in the direction of coordination and consultation, and the number of environmental soft law will increase. In addition to traditional administrative means, social organizations participate in the implementation of environmental law and the implementation tools of market environment law, which will constitute the other two elements of environmental law enforcement. There will be continuous modernization in the judiciary, the responsiveness and resilience of environmental justice, and the enhanced dialogue will be significantly enhanced. In order to supervise the people and the government, we will supervise and urge the government to fulfill its environmental management responsibilities through the supervision of law and public interest litigation. This change is to use the legal form to construct the three - dimensional relationship in environmental governance, and to realize the co-governance of the synergistic effect of the three.
