摘要
2015年修改后的《立法法》赋予民族自治州兼有制定一般地方立法和自治法规的双重立法权,从实证角度对相关立法实践进行针对性分析不仅有利于解决自治州面临的现实困境,更能在宏观上确保设区的市立法权制度的规范运行,但这却是当前研究的薄弱环节。《立法法》修改3年来,XX自治州在强化党对立法工作的领导、稳妥实施地方性法规制定权、积极开展区际生态协同立法、锐意提升立法民主性以及创造性解决立法队伍紧缺问题等方面成就斐然,但同时也面临一般地方立法权范围的规范界定之困、双重立法权区分的畛域之惑、政府规章制定相对滞后的意识之疏以及机制创新诱发的次生问题之虞。对此,可从廓清一般地方立法权范围、厘清双重立法权选择标准、认清地方政府规章的制度价值以及走出自治州立法人才不足的困境等方面探索解决方案,并在此基础上推广经验。
Autonomous prefectures gained double legislative powers of formulating general local legislation and autonomous laws and regulations when Legislation Law was amended in 2015.Making an analysis of relevant legislative practice is not only helpful in solving many problems of autonomous prefectures,but also can ensure the standardized operation of the municipal legal right system which is ignored in current researches.Three years after the amendment of Legislation Law,Xiangxi Prefecture has gained achievements such as strengthening CCP ＇s legislative leadership,implementing local legislative power,carrying out synergetic legislation for interregional ecology,promoting legislative democracy,and solving the shortage of legislative teams.Meanwhile,the prefecture also faces problems such as fuzzy boundary of local legislative power,confused dividing line between dual legislative powers,hysteretic enacting of local government ＇s regulations and other secondary problems caused by mechanism innovation.Therefore,the solutions should include making clear the scope of general local legislative power,providing the alternative mode between the two kinds of local legislative power,understanding the value of local governmental regulations,solving the problem of lacking legislative talents,and finally promoting experiences to other places.
