摘要
财产刑执行检察监督是检察机关法律监督职能的应有之义。我国现有的法律体系规定和司法实践制度还难以满足现实的需要。通过对重庆的实证调查可以发现,检察机关在财产刑执行检察监督中还存在立法规定不明确、财产刑适用范围过于宽泛、检察机关应对经验不足、人财物保障不足、监督手段缺乏强制性、监督效果不明显等问题。要完善财产刑执行检察监督的制度构建,需要从完善财产刑执行检察监督法律规定,建立检察机关主动介入制度,建立财产刑执行检察监督保障制度等多个方面予以改进。
The prosecution supervision of property punisliment is the proper meaning of the legal supervision function of procuratorial organs. However, the existing legal system regulations and judicial prac tice systems in China are s tilldificult tomeet the actualneeds. Through an empir ical investigation of Chongqing, it can befound that the procuratorial organs still have unclear legisla tive provisions in the supervision of propertypunishment, and the scope of application of property punishment is too broad ; the procuratorial agencyresponds to insuff icient experience, insuff icient human and material security, and lacks mandatory supervisionmeasures. Not obvious is sues. Therefo re,it is necessary to improve the system construction of the procuratorialsupervision of the execution of property punishments from the aspects of improving the lega l provisions forprocuratorial supervision of property criminal execution, establishing a procuratorate active intervention system, and establishing a property criminal execution procuratorial supervision and security sy s tem, e tc.
