摘要
加强食品安全法律治理是当代世界的普遍趋势。为了应对食品安全监管法律的失灵,印度颁布了《食品安全标准法》。本文通过跟踪印度《食品安全标准法》在2017年9月至今发布的重要修订情况,分析印度《食品安全标准法》在统一监管体制、以科学为基础的风险管理、执行措施多元化以及司法专门化四大变革方面存在的利弊,结合我国现行的食品安全法规和标准情况,指出我国在食品安全标准方面的三点不足,并针对提升我国食品安全水平提出建议。
In recent years, there have been many had food safety problems in the society. Food is essential for the survival and development of human beings. Food safety is the basic guarantee of human health, and it is related to the national economy and people's livelihood of a country. In this paper, by analyzing the revision of Food Safety Standards Act in India that was released in September 2017, in combination with related literature analysis of the pros and cons of India in terms of a unified regulatory system, science-based risk management, diversification of enforcement measures, and four major changes in judicial specialization is the Food Safety Standards Act, the shortcomings and reasonable suggestions are put forward according to China's current food safety regulations and standards.
