摘要
在刑罚制定、刑罚裁量和刑罚执行等三个重要环节中,刑罚制定的科学与合理是刑罚裁量准确与公正的基本前提,而刑罚裁量的准确与公正则是刑罚执行效果和行刑目的实现的必要保证。刑罚裁量在这三个重要环节中起着承前启后的、至关重要的关键作用。适应性机制在刑罚裁量中的实现,最根本、最核心的命题就是刑事法官量刑自由裁量权的范围确定与边界划分问题,其实质内涵也就是量刑规范化的具体实现及其实现程度问题。在整个规范化的刑罚裁量活动中,重点涵盖了量刑模式、量刑起点、基准刑、量刑情节等相关核心概念,需要对这些概念进行科学而合理的适应性调整,以此促进适应性机制在规范化的量刑活动中充分而必要地实现。
In the three important links of penalty formulation,penalty discretion and penalty execution,the science and rationality of penalty making is the basic premise of accurate and fair punishment,and the accuracy and impartiality of penalty judgment is the necessary guarantee for the effect of penalty execution and the purpose of execution. Penalty discretion plays a key role in these three important links. In the judgment,the most fundamental and core proposition for the realization of the adaptive mechanism is the determination of the scope and boundary of the discretion of the criminal judge,and its essence is the concrete realization of the standardization of sentencing and its implementation. In the whole standardized penalty discretion activities,it mainly covers the core concepts of sentencing mode,starting point,benchmark punishment and sentencing plot,and these concepts need to be adjusted scientifically and reasonably to promote the adaptive mechanism in the standardized sentencing activities in full and necessary implementation.
