摘要
在知识产权侵权中引入惩罚性赔偿已是大势所趋。合理确定赔偿数额是惩罚性赔偿功能发挥的基础和关键。适用惩罚性赔偿确定赔偿数额的第一要义需要明确赔偿数额的基准和惩罚幅度,强化有效性和可操作性。
The introduction of punitive damages in intellectual property infringement compensation has become the trend. Reasonable determination of the amount of compensation is the basis and key to the function of punitive damages. Apply ing punitive damages to determine the first essential meaning of the amount of compensation needs to clear the eompensation amount of the benchmark and the scope of punishment, and strengthen the effectiveness and operability.
