摘要
从侦查、起诉到审判,整个刑事诉讼活动都围绕着证据展开。法官依据证据来认定事实进而作出裁判,检察机关能否精准指控犯罪的关键在于证据是否充分。检察机关应构建以证据为核心的刑事指控体系,并从理论层面上和实践层面上进行分析和阐述。从理论层面上,检察机关在审查起诉时应全面贯彻证据裁判规则,严格把握审查起诉标准,重点对非法证据排除规则,传闻证据规则,瑕疵证据补正规则,口供证据补强规则进行了分析,对排除合理怀疑的标准进行了剖析。从实践层面上,从强化庭审前对证据的审查和加强庭审过程中对证据的掌控力进行了论述,以期对司法实践有所裨益。
From investigation, prosecution to trial, the entire criminal proceedings are centered on the evidence. Ev-idence is the basis on which judges affirm facts and make judgments. Whether the prosecutorial organ can accurately accuse the criminal depends on whether the evidence is sufficient. The group proposes that the procuratorate should construct the evidence-based criminal allegation system, and analyzes from the theoretical and practical perspec-tives. From the perspective of theory, the group believes that procuratorate should fully implement the rules of evi-dence adjudication in the stage of review and prosecution, strictly observe the standard of review and prosecution. The group focuses on the analysis of the exclusionary rule of illegally obtained evidence, hearsay evidence rule, rule for correcting defective evidences and rule for the reinforcement of oral evidences. From the practical level, the group reviews the evidence before strengthening the trial and strengthens the control of the evidence in the process of court trial in order to benefit the judicial practice.
