摘要
国际航运市场持续低迷,造船、航运企业破产进入频发、多发期,跨境破产程序和海事程序的矛盾和冲突在航运企业跨国破产程序中集中凸显。从航运企业跨国破产程序的救济形式和范围出发,针对船舶优先权人的权利是否应受到跨界破产程序的影响;在外国破产程序被承认前,被扣押船舶是否受到跨界破产程序的影响;非债务人自有船舶是否受到跨界破产程序保护等问题,结合相关国家海事跨国破产程序的制度实践,提出应当合理保护海事优先权人利益,使破产程序承认前已进行的船舶扣押免受破产程序的影响,根据行业特性扩大对于破产企业所有船舶的解释等意见,希望对中国跨国海事破产救济制度的规范和完善有所助益。
As the international shipping market continued to be sluggish,the bankruptcy of shipbuilding and shipping companies happened frequently. The conflicts between cross-border bankruptcy procedures and maritime procedures were highlighted in the transnational bankruptcy proceedings of shipping companies. In the cross-border insolvency process of shipping companies,we usually need to consider the form and scope of relief,such as whether the rights of the ship's priority should be affected by cross-border bankruptcy procedures,whether the seized ship is subject to cross-border insolvency before the foreign bankruptcy procedure is recognized,and whether the non-debtor's own ship is protected by cross-border bankruptcy procedures. Starting from the above three aspects,the paper proposes to reasonably protect the interests of maritime priority people so that the ship seized before would not be affected by the bankruptcy proceedings,and expand the interpretation of the ships owned by the bankrupt enterprise according to the characteristics of the industry.
