摘要
以数字平台为媒介的工作究竟是"灵活自由的"还是"受到严格控制的"?数字平台工作参与者是"雇员"还是"独立合同工"?现有文献观点不一。已有文献主要从劳动法律的角度围绕从属性展开分析,本文认为,应将平台工作关系主体置于讨论的出发点,并采用"控制动机—事实从属性"的两层次分析框架。通过对P网约车平台的案例分析,我们认为,平台企业商业策略的复杂、多变性是造成用工性质判定困境的根源;在这种情况下,劳动关系的质量与主体双方的策略选择密切相关。对于以网约车平台用工为代表的新型工作安排,应当对平台企业策略选择、劳动者的异质性、劳动者相对于平台的事实从属性给予充分关注。
Is the nature of work on digital platforms "flexible" or "under strict control" ? Are workers working via digital platform employees and independent contractors? No consensus has been reached in current literature, which mainly did their analysis base on dependency from labor law angle. This article holds that the specialty of actors should be analyzed at initial and a two-step analysis framework "motivation of control-actual dependency status" should be adopted. According to the case study on P car-hailing platform, we find that the complexity and changeable nature of platform company lead to platform employment relationship judging dilemma; the quality of employment relationship depends on strategic choice of both actors. Thus, when analyzing platform intermediated work arrangements represented by car-hailing platform, more emphasis should be put on firm's strategic choice, heterogeneity on labor side and the worker' actual dependency status to the platform.
