摘要
现行食品安全法及其规章将网络食品监管的部分义务赋予给网络食品交易第三方平台提供者,然而义务履行情况却与立法者的设计目标有所差距。通过对网络食品交易第三方平台提供者义务设置的合理性进行反思,可以发现现行立法为网络食品交易第三方平台提供者所设置的法定义务是建立在对相应理论偏颇适用的基础上,并且在某种程度上超出了网络平台的现实能力,进而导致义务旁落。为此,应从三方面对网络食品交易第三方平台提供者的义务进行重构:理论适用之全面性,惩罚与激励并存;法定义务建构之确定性,细化相关法律制度,使法定义务便于履行;客观能力之匹配性,政府信息提供职能及时跟进,共建食品安全大数据信息共享网络等工作。
Current food safety law and its regulations endow part of the obligations of online food supervision to the third party platform providers in online food transactions. However,there is a gap between the performance of obligations and the design goals of legislators. Through reflection on the rationality of the obligations of the third party platform providers in online food trading,people can easily find that the legal obligations set by the current legislation for the third party platform providers of the network food trade is based on the application of the corresponding theory,and to some extent beyond the practical ability of the network platform,which leads to the obligation to be sidelined. Therefore,we should reconstruct the obligation of the third party provider of the network food trade from three aspects: the comprehensiveness of theory application and the coexistence of punishment and encouragement; the certainty of statutory obligation construction should refine the relevant legal system so as to make legal obligations easier to perform; the matching of the objective ability,the function of government information supply should be followed up promptly thus constructs the food safety big data information sharing network and so on.
