The Influence of Search Engine on Information Dissemination and Its Legal Regulation

摘要 互联网信息分布零散、体量庞大的特征日益凸显出对信息组织、分类和过滤的重要性,这导致搜索引擎占据了现代社会信息传播的枢纽位置。由于控制了公众对信息这一重要资源的可及性,搜索引擎具有显著的公共性。搜索引擎公司根据自身商业利益来影响信息的结构、编排,凸显和遮蔽信息的现象,说明法律根据公共利益来规范搜索引擎服务的必要性。否则,信息的多元性、个人自治等诸多价值将会受到挑战。但是,搜索算法中的主观判断因素使得难以按照某种统一、客观的标准要求搜素引擎"中立",规制方案应当聚焦于强化信息披露、合理使用结构性规制并激励行业自律等方面。 The fragmented and huge volume nature of Internet information is increasingly indicative of the importance for information organization, classification and filtering, and more importantly, what rule should be followed by the above - mentioned activities. Locating on the bottleneck of the Internet information disseminating system, search engines can highlight and obscure some information by struc- ture and choreography, which give them the power of constructing meanings. Once out of control, this power will profoundly affect the diversity of information, individual autonomy, economic efficiency and many other values, which constitutes a legitimate basis for government intervention. At the same time, subjective judgments in search algorithms make it difficult to ask search engine for "neutrality" which ask for some uniform and objective criteria. Regulatory programs should focus on strengthening informa- tion disclosure, using structural rules rationally and encouraging industry self- regulation.
