摘要
防御权是公民基本权利的根本功能,尤其是自由权的最主要功能。防御权功能为国家公权力划定领域标界,保护基本权利排除国家公权力的侵害。防御权功能赋予了公民排除国家恣意侵害的请求权和国家承担消极保护的义务。立法机关、行政机关和司法机关应当履行防御权保障人权的国家消极义务,不得恣意侵犯公民的基本权利。因此,防御权功能是法治社会的基石。
defense rights are the fundamental function of citizens＇ basic rights, especially the most important function of freedom right. The function of defense rights is to demarcate the demarcation of the public power of the country, and protect the basic rights from the violation of the public power of the country. The defense right function gives citizens the right to waive the country＇s wanton infringement and the state＇s obligation to undertake negative protection. The legislature, the administrative organs and the judiciary should fulfill the state＇s negative obligations of safeguarding human rights and must not arbitrarily violate the basic rights of citizens.Therefore, the defense right function is the cornerstone of the rule of a law society.
