摘要
美国国家治理模式自上世纪80年代开始向现代监管型国家转型,逐步确立了以事前监管影响评估和规章集中审查为代表的监管政策。2007年次贷危机爆发后,奥巴马政府积极推动监管政策改革,建立了事后监管影响评估制度,并尝试要求独立监管机构适用监管政策,以期减少监管成本。美国监管政策的改革经验为落实我国《"十三五"市场监管规划》提供了有益的借鉴。国务院可以制定市场监管政策,要求监管机构对重大规章进行市场监管影响评估,并授权国家市场监督管理总局审查影响评估报告,以保证各监管机构出台的规章符合《"十三五"市场监管规划》的要求。
Ever since the 1980 s,the U. S. state governance regime has been gradually transforming to the modern regulatory state and has established the regulatory policy mainly including the ex ante regulatory impact assessment and the centralized review of draft regulation. After the Subprime Crisis in 2007, the Obama administration further reformed the regulatory policy to reduce regulatory burdens by establishing the ex post regulatory impact assessment system,and tried to apply regulatory policy to independent regulatory agencies.The experience of U. S. regulatory reform provides a valuable reference to the implementation of China＇s ＂13 th Five-Year Plan for Market Regulation ＂. The State Council could introduce market regulatory policy, and require regulatory agencies to perform market regulatory impact assessments of major regulations. The State Administration for Market Regulation should be delegated with the authority to review market impact assessment reports,so as to ensure that regulations conform to the requirements of the ＂13 th Five-Year Plan for Market Regulation＂.
