摘要
中国处于改革开放四十年的转型巨变中,若累积叠加的多重风险超过一定边界,极易导致社会冲突现象的频发。本文从江苏镇江实地调研的拆迁冲突事件出发,依据社会冲突理论为研究基础,以"第三方"治理主体为研究对象。调研发现,"第三方"治理主体具有"官民二重性"和"草根本性"等多种角色,有其独特的形成机制,并构成多元参与的治理格局。其间,"第三方"既发挥着正功能,同时出现负功能,继而产生利益之争、权力之困和权利模糊等状况。因此,需厘清多元治理主体的利益、权力和权利的边界,并构建良性互动的边界秩序,使得"第三方"治理主体更好地发挥社会"减压阀"的功能。
In the midst of the drastic social transformation of modernization in China for 40 years, once the cumulative risk exceeds certain boundaries, it can easily lead to frequent social conflicts. The demand of land for urbanization is the background of generating land expropriation and demolition conflicts. This paper based on the theory of conflict governance embarks from the field investigation of conflict governance case, uses governance body of ＂ third party＂ in the city demolition to illustrate and gives profound analysis to the impact of＂ third party＂participation in conflict governance. It takes social conflict as the theoretical basis and the＂ third party＂governance entity in the demolition of cities as the research object, which leads to the findings of the unique essence of＂third party＂, the forming mechanism of ＂ mature opportunity＂ and the constitution of a multiparticipation governance structure. Therefore,＂ third party＂ not only exerts the positive function, but also results in negative effects, which trigger the competition of benefits, the dilemma of powers and the fuzzy of rights and so on. It requires clarification of the benefit of diversified governance body and the boundary of the power and right to establish the order of the boundary. In this case, the pattern provided a new reference for conflict governance mode, making the society more harmonious.
