摘要
受我国长期以结果正义观念为主导的影响,近代引入西方的程序正义的理论后,正当程序制度的发展仍然较为缓慢,也因此导致了我国司法实践中为数不少的冤假错案的发生。程序正义是实体正义的保障,程序正义的缺失可能在很大程度上阻碍法治社会的发展。正义不仅要得到实现,而且要以人们看得见的方式得到实现,这是司法改革中推进程序正义的基本要求。
After the introduction of western procedural justice theory in modern times,due to the influence of the long-term concept of results justice,the development of the due process system is still relatively slow,and thus led to a large number ofinjustice cases in judicial practice. Procedural justice is the guarantee of substantive justice,and the lack of procedural justice may hinder the development of nomocracy society. Justice is not only to be achieved,but also to be realized in a way thatpeople can see,which is the the basic requirements for the advancement of procedural justice in the judicial reform.
