摘要
新时期黑恶势力犯罪呈现出犯罪手段更加隐蔽、犯罪领域扩张、犯罪性质复杂等新的态势,以管制、制裁和运动式执法为特征的传统犯罪惩罚模式已难以有效应对。2018年1月出台的《关于开展扫黑除恶专项斗争的通知》要求黑恶势力犯罪防控的主体更加多元、方法更加丰富、程序更加规范,取得更好的犯罪控制和预防效果。贯彻中央政策,适应现实需求,应从激发社会力量参与、精准适用刑事制裁手段、重视对犯罪人的社会矫治、消除犯罪滋生的环境等方面构建黑恶势力犯罪治理模式,对处于不同阶段、具备不同行为特征的黑恶势力犯罪予以分层次打击、分情况处理,尤其要将治理黑恶势力犯罪与反腐败双管齐下,切断犯罪的社会情境供给。
The crime of mafia-like gangs in the new period presents a new trend of concealment of criminal means,expansion of the field of crime,complex nature of crime and so on. The traditional criminal punishment mode characterized by authority control,sanction and periodic campaign has been unable to effectively cope with this new trend. The notice on the Campaign of Eliminating the Mafia-like Gangs in January 2018 requires that the main body of the crime prevention and control of the mafia-like gangs should be more diverse,richer in methods and more standardized in procedure,so as to achieve better crime control and prevention effect. To implement central government’s policy and meet people’s needs,we should construct a crime governance model of the mafia-like gangs from the aspects of stimulating the participation of the social forces,applying the criminal sanctions accurately,attaching importance to the social correction of the criminal and eliminating the environment for breeding of crime. Crimes committed by Mafia-like Gangs at different stages and with different behavioral characteristics should be dealt with separately. In particular,the punishment of the Mafia-like Gangs crimes and the anti corruption should be combined to cut off the supply of the social situation of the crime.
