摘要
推行公安机关刑事案件法制部门"统一审核、统一出口"工作机制改革,既是贯彻中央决策部署,落实依法治国方略,有效改进公安机关执法权力运行机制的重要任务,也是积极适应以审判为中心的司法制度改革,健全冤假错案预防机制,深化执法规范化建设的有力制度保障。推行"两统一"改革,应厘清"两个认识",统一思想,明确改革方向;加强机构建设,明确职责,做好组织保障;加强制度建设,细化标准,提供制度保障。此外,推行"两统一"改革还应做好配套工作,如建立争议解决制度、责任追究机制和执法考评机制等。
It is the requirements of the central government＇s decision, the practice of law-basedgovernance of the country and the main task of the mechanism reform of the police＇s law enforcement operationto implement＂unitary audit and unitary prosecution＂mechanism in criminal investigation unit of policeagencies. Moreover, it is also a system guarantee to adapt to the trial-centered judicial reform, to perfect theprevention mechanism of unjust and wrong cases and deepen the standardization construction of lawenforcement. The reform of＂unitary audit and unitary prosecution＂requires a clear direction by clarifying theboth connotations and reaching consensus, an organizational guarantee by strengthening its construction andmaking duties clear, a system guarantee by institute construction and refining the criteria. Besides, the reformrequires the auxiliary work such as dispute settlement mechanism, responsibility investigation mechanism andlaw enforcement assessments.
