摘要
基于文献研究和经验分析提出关于农村土地确权的三个观点:当前土地确权的基础是不稳固的;当前的土地确权模式可能导致严重的经济和社会后果;农村土地确权推进应以遵从乡野实践和地方性知识为前置条件。通过对山东省五市七镇的调研,对新一轮农村土地确权的情况进行细致分析,对三个观点进行检验,结果表明,观点一和观点二可以被很好地验证,而观点三因缺乏十分有力的证据支持不能被证实。在此基础上,提出了农村土地确权的实施理念、路径选择、模式选择及确权的核心、关键和保障条件。
Three hypotheses about the rural land rights confirmation are put forward based on the literature researches and empirical analyses,which are the foundation of the current land rights confirmation is not stable,the current land rights confirmation patterns may lead to serious economic and social consequences,and rural land rights confirmation should put the countryside practice and local knowledge as the precondition.Based on the investigation of five cities and seven towns in Shandong Province,this paper analyzes the new rural land rights confirmation and validates the three hypotheses.The results show that hypothesis 1 and hypothesis 2 can be well confirmed,but hypothesis 3 can not be confirmed for the lack of strong evidence.On this basis,the implementation concept,path selection,mode selection,the key and guarantee conditions of rural rights confirmation are put forward.
