摘要
推进国家监察体制改革的关键是实现法治化反腐,而实现法治化反腐必然要厘清国家监察权与行政监察权、纪检监督权、检察监督权(限于司法属性的职务犯罪侦查权)等"子"权的关系;优化国家监察权内部监督与外部监督相互制约监督的机制,科学推进国家监察立法为法治化反腐提供制度支撑;落实人权保障理念贯穿于《监察法》及监察权运行之始终;营造"社会中心主义"参与反腐的"理性构建"图景,运用法治思维、法治方式反腐,亦是推进国家监察体制改革法治化的应有选择。
The key to promote the reform of national supervision system, implementation of anti-corruption law is to clarify the national supervision and administrative supervision, discipline inspection and supervision, procuratorial supervision（limited to itself right） the relationship between ＂Zi＂right; optimizing the supervision power of the internal supervision and external supervision, promote national legislation to provide institutional support for the rule of law in the implementation of anti-corruption; the concept of human rights protection in ＂supervision law＂, the supervision power is always running; create a＂mirror social center＂mode of people directly involved in corruption, the rule of law thinking, the rule of law, also should choose to promote the national anti-corruption supervision committee legalization path.
