摘要
"义务"与"责任"作为道德哲学与法哲学的核心概念经常被替换使用。哈特是较早区分"义务"与"责任"的当代法哲学家之一。自哈特以来,越来越多的论者开始区别使用这两个概念,并在此基础上区分了自然责任与职责概念。哈特对"义务"与"责任"的区分与他的"特殊权利"和"一般权利"相联系,但哈特并没有一以贯之地区别使用"义务"与"责任"概念,这是他的义务与责任概念所存在的混乱和困境之根源。
"Obligation"and"duty"are both central concepts in moral and legal philosophy,which are always used interchangeably. H. L. A. Hart is one of the earliest contemporary legal philosophers who distinguished obligation from duty. More and more theorists since Hart tried to make one distinction between obligation and duty and another between natural duty and positional duty. Hart distinguishes obligation from duty in the relationship with his concepts of "special rights " and "general rights ".However,Hart does not distinguish them consistently. And this is the root of the confusions and difficulties about his concepts of obligation and duty.
