摘要
就像中国社会科学一样,中国的法理学也具有典型的移植品格;尽管中国法理学具有自己的特殊性,但对于其教材的更新来说,英美法理学教材或读本构成了一个有用的参照标准。英美法理学教材的论题和内容都比较哲学化和理论化,跨学科的色彩非常明显,尤其与政治哲学和道德哲学联系紧密;一般也都包含部门法哲学的内容;但并不追求逻辑性和体系上的一贯性。与之相比,目前我国法理学教材在知识传授、思维训练以及教学的可接受性等方面都面临着的困境,这一困难的根源在于我国法理学教材定位的不合理以及在知识体系上的陈旧与落后。法理学教材的定位应当是传授理论知识、启发理论思维和培养理论兴趣,而非再强调对部门法学不切实际的指导作用;淡化学科色彩,回归法理本身;弱化对体系性的追求,强化对法学之普遍问题和一般理论的哲理化研究。因此,编写一部带有中国问题意识的、理论化的、内容上有创新的、表述风格上有重大改观的法理学教科书是当务之急。
Like Chinese social sciences, China' s"jurisprudence" also has a typical transplant character. Although jurisprudence in China has its own particularity, Anglo-American jurisprudence textbooks or reading materials can be considered as a useful reference standard. The Anglo-American jurisprudence textbooks are more philosophical and theoretical, and the interdisciplinary features are very obvious, especially closely connected with political philosophy and moral philosophy. Generally speaking, the jurisprudence of the departmental laws is included, but its logic and the system consistency is not in pursuit. In contrast, at present, the teaching materials of"jurisprudence" in China are facing with difficulties in such fields as the knowledge teaching, thinking pattern training and the acceptability of teaching. The root of those difficulties lie in the unreasonable positioning of "jurisprudence " and the old and backward in knowledge system. The orientation of jurisprudence textbooks should be to disseminate theoretical knowledge, to inspire theoretical thinking and cultivate theoretical interest, rather than to emphasize the unrealistic guiding role of departmental laws. A series of things should be achieved for jurisprudence teaching materials, such as to dilute the color of discipline, to return to "jurisprudence" itself; to weaken the pursuit of system, to strengthen the study of the general problems of law and the general theory of philosophy. Therefore, it is imperative to write and compile a jurisprudence textbook with the awareness of problem- sensitive in Chinese environment, a theoretical and innovative content that has a significant change in narrative style.
