摘要
处于初创阶段的亚洲基础设施投资银行在争端解决机制上存在不足之处,而完善有效的争端解决机制是其健康运营的保障。亚洲基础设施投资银行的争端解决机制与其他多边开发银行进行对比,尽快完善是十分必要的:一是亚投行在业务上的争端,包括其与借款人的争端,其作为直接投资人与东道国的争端,其进行贷款担保时与债务人的争端;二是亚投行与内部职员的争端,三是亚投行与第三方的争端。重点放在亚投行业务上的争端,结合亚投行目前的立法和世界银行的有益经验,亚投行应当在上海创建贷款—投资争端解决中心,以协商和仲裁方法解决争端。
There have been imperfections in the dispute settlement mechanism of the Asian Infrastructure Investment Bank which is at its initial stage and an effective dispute settlement mechanism is the guarantee for the healthy operation of the Asian Infrastructure Investment Bank.This paper discusses the issues regarding the dispute settlement mechanism of the Asian Infrastructure Investment Bank and makes comprehensive analyses,by comparing with other multilateral development banks and putting forward suggestions. Firstly,this paper describes the necessity of this topic. Secondly,it describes the dispute settlement mechanism of the Asian Infrastructure Investment Bank.Then,it analyses from three aspects：Firstly,the Asian Infrastructure Investment Bank＇s disputes in business,including its dispute with the borrower,which serves as a direct investor and the host country of the dispute,the loan guarantee and the debtor ＇s dispute. Secondly,the Asian Infrastructure Investment Bank and the internal staff of the dispute.Thirdly,the Asian Infrastructure Investment Bank and the third party dispute Bank. This paper focuses on the bank＇s disputes in business and combines the current legislation of Asia Infrastructure Investment Bank and draws useful experiences from the World Bank. It is suggested that the Asian Investment Bank creates its Loans-Investment Dispute Settlement Center in Shanghai and settles disputes through consultation and arbitration.
