摘要
[目的/意义]从法治的角度解读党的十九大报告提出的"建立网络综合治理体系"等新战略,就需要研究网络综合治理法律体系。[方法/过程]通过梳理中外学者关于互联网立法的论述,发现分层思维的重要性,据此以网络使用为内核,可以从两个层次定义网络综合治理法律体系的内涵。[结果/结论]在此基础上,剖析了网络综合治理法律体系的内部规范结构,结合现阶段的立法现状发现其重点在于维护网络安全、促进网络交易和网络服务、防范网络犯罪等方面,但是在保障网民权利、促进政府治理转型、完善网络知识产权保护、发展网络司法制度等方面存在较大的不足,于是建立新时代网络综合治理法律体系应该按照"夯基础、查漏洞、补短板"的路径进行,并提出了应重点加强的立法。
[Purpose/Significance]From the angle of rule of lawon legal system of internet comprehensive governance,understanding of ＂ establish a internet comprehensive governance system ＂ in the report of the 19 th CPC National Congress is necessary.[Method/Process]By combing the previous Chinese and foreign scholars on internet legislation,we find importance of hierarchical thinking,and define the connotation of legal system of internet comprehensive governance. [Result/Conclusion]On this basis,combined with the legislative situation,we analyze internal structure of legal system of internet comprehensive governance,find that the focus of the current legislation is to promote maintenance of network security,network transactions and network services,and to prevent cyber crime,but there are deficiencies in protection of civil rights,transformation of government governance,protection of internet intellectual property and development of network judicial system,so to establish legal system of internet comprehensive governance in a newera should be in accordance with the path of ＂ ramming foundation,checking loopholes and making up the short boards＂,and we also put forward the general content of legislation that should be emphasized.
