摘要
知识生产的不同方式对应着不同属性的理论类型。某种流行的知识生产方式往往容易产生对其他知识生产方式的压制乃至否定。在法理学教学中便表现为,老师与学生拒斥纯理论的研究,更喜好应用型、对策型的研究,反对乃至否定概念性、纯分析性的研究,在此潮流之中,经典阅读也就变得越来越不重要。这样的处理方式既不能得到证成.在认知和实践的维度也滋生了诸多的混淆与危害。经典阅读既关乎如何做一个好的理论研究.也关乎如何过一个好的生活。对于在法理学教学中倡导经典阅读来说,需注意经典阅读的范围、限度与方法。
Ditterent ways or knowledge producing generate dll terent types of theories. Usually one prevailing way suppresses others and even denies their justification. In legal education it appears as the refusal of conceptual and analytical theory research by teachers and students and the acceptance of applied and practical research. The necessity and significance of classics reading in the research is denied and disclaimed. In such a trend, classics reading is becoming less and less important. The research methods can neither be effectively proved nor prevent the misconceptions and contamination of the students' cognitions and practice. Classics reading does not only concern the appropriate way of conducting theoretical research, but also relates about the way of leading an appropriate life. In the promotion of classics reading in jurisprudence teaching, the scope, limits and methods of the reading should be closely paid attention to.
