摘要
法官员额制是司法改革的一项重要举措,施行过程中存在较多问题。基于经验研究与逻辑思辨之方法,透析改革暴露出来的问题,如"法官离职现象""案多人少状况""司法效率低下""法院行政化""模糊职责定位"等,挖掘改革本身不完善之处,如"传统行政化体制""资源配置不协调""选任标准固化"等,剖析制度异化的根本问题,如"改革限制与逻辑悖论""重构秩序的杂乱困境""改革过程障碍""改革程序非实质性""改革制度滞后性与不确定性"等,最终确定适合我国法官员额制改革的基本向度,包括加强审判独立理念、优化法院资源配置、迈向精英司法未来之路。
The judge post system is an important measure of judicial reform, but there are many problems in the process of its implementation. Based on methods of empirical research and logical thinking, we should analyze the prob- lems exposed by reform, such as： ＂judge dimission phenomenon＂, ＂few judges with lots of cases＂, ＂low judicial effi- ciency＂, ＂administrative characters of court＂, ＂fuzzy duty position＂ and so on. We should dig out the imperfections of reform itself, such as： ＂traditional administrative system＂, ＂uncoordinated resource allocation＂, ＂immobilization of elec- tive standards＂ and so on. We should dissect the fundamental problems of system alienation, such as： ＂reform limitation and logical paradox＂, ＂confusion of reconstruction order＂, ＂obstacle of reform process＂, ＂non-substantive reform pro- cedure＂, ＂lag and uncertainty of reform system＂ and so on. Finally, we could determine the basic orientation for the judge post system reform in China, include strengthen the concept of independent trial, optimize the allocation of court resources, and running to the future road of elite judicature.
