摘要
对当前家庭医生制度试点实施过程中存在的问题进行法理分析,为促进我国家庭医生制度的法制化建设提供建议。基于执业医师法、医师多点执业办法等法律、法规和规章,分析家庭医生制度在人员配备、技术提供及资质认证等方面存在的问题及原因。我国目前已出台了相关政策鼓励家庭医生制度的推行,但由于缺乏具体的法律规制,制度运行时仍然面临资质认证标准不规范、执业注册不规范、医疗服务质量不好等问题。建议借助于法律的引导功能,完善家庭医生的执业资质认证标准,放宽医师多点执业政策,提高家庭医生的中医药服务能力,以推动家庭医生制度和我国基本医疗服务体系的健康发展。
Through the legal analysis of the existing problems in the implementation process of the current family doctor system,we provide suggestions to promote the legal construction of the family doctor system in our country. Based on the practice of physician law,the doctor multi-sited practice methods and other policies and regulations,this article analyzes the shortcomings and reasons in staffing,technical provision and qualification and other aspects of family doctor system. China has introduced a series of policy documents to promote the implementation of the family doctor system,but the system still needs to regulate the operation of its qualification,nonstandard practice registration and low quality of medical services and so on due to the lack of specific laws and regulations. It is suggested that by virtue of the guiding function of the law to improve the standard qualification of family doctors,relax the doctor＇s multi-sited practice policy and improve the family doctor＇s ability to serve Chinese medicine to promote the healthy development of family doctor system and basic medical service system in China.
