摘要
组织、利用邪教组织致人死亡属于组织、利用邪教组织致人重伤、死亡罪的相对的必要要件,致人死亡结果是组织、利用邪教组织致人死亡罪的必要条件。蒙骗行为是组织、利用邪教组织致人死亡罪中承担刑责的基本行为,蒙骗行为与死亡结果之间具有非直接关联性,蒙骗行为人控制被害人或被蒙骗者的企图是其形成主观罪过的基础,蒙骗行为人对于死亡后果只能是过失的心态。
Organizing and utilizing Heretical Cult Organizations to causing death belongs to the relative necessary condition of the crime of organizing or utilizing heretical cult organizations to causing serious injury or death, in which the result of death is the necessary condition. Deception is the basic behavior that bears criminal liability in the crime. There is a indirect correlation between deception and death. The attempt of the perpetrator to control the victim is the basis of his subjective fault. The perpetrator causes the victimJ s death unintentionally.
