摘要
在虚假广告治理中,侵权诉讼不仅可以规范广告活动、保护消费者合法权益,还可以促进虚假广告公共规制。虽然法律规定了虚假广告侵权责任,但实践中虚假广告侵权诉讼仍面临着诸多困境,约束了其功能的发挥。在全球化背景下,各国的虚假广告立法呈现出诸多共同点,侵权诉讼在虚假广告治理中发挥着越来越重要的作用,公共规制与侵权诉讼的互动关系日益明显。与此相适应,我国虚假广告侵权制度亦应进行调整,从而更好地实现虚假广告侵权诉讼的预期功能。
During the regulation of false advertising, tort litigation can not only help regulate adver- tising activities and protect the legitimate rights and interests of consumers, but also facilitate public reg- ulation of false advertising. Even though tort liability for false advertising has been written in the law, the tort litigation is still facing some plights, thus restricting the normal functions of tort litigation. Under the background of globalization, false advertising legislations in different countries are sharing more and more common points; namely, tort litigation is playing a more and more important role in the regulation of false advertising, and tort regime and public regulation are increasingly interacting with each other. Therefore, China should also adjust the existing tort regime for false advertising, so as to realize the an- ticipated functions of tort litigation to a better degree.
