摘要
第三人代履行是《行政强制法》上一种重要的行政强制执行方式,不仅符合民营化的时代潮流,而且能够缓和执法过程中的官民对立。该项制度的展开,需要对代履行制度的应用、行政机关与第三人代履行的选择、第三人的积极资格与消极资格展开讨论,增强其实践生命力。
The third party ＇ s performance on behalf of the party concerned is an important measure of enforcement in Administrative Compulsion Law. It not only accord with the tide of the privatization,but relax the opposition of officials and civilians. We should discuss the application of this institution,the choice of the administration and the third party,positive and passive qualification in order to strengthen its practical vitality.
