摘要
《中华人民共和国公共图书馆法》的颁布为社会力量参与公共图书馆建设提供了法律依据。法案内有关社会力量参与公共图书馆建设的条款,既明确了社会力量参与公共图书馆建设的合法性,又在参与方向上给出指导性的意见。本文联系实际,解读分析了该法案内规划扶持、捐赠引导、表彰奖励、志愿者服务几个引导社会力量参与公共图书馆建设方面的条款,提出了社会力量参与公共图书馆建设的可行方向,指出了该法案在社会力量的注册性质认定、社会力量的专业能力规范、运营管理规范、捐赠规范等几个方面还存在细节不完善的问题。
The enactment of People＇s Republic of China Public Library Law provides policy basis for social force to participate in public libraries＇ construction. The provision of social force＇s participation in the construction of public libraries not only clarifies the legitimacy of social force to participate in the construction of public library, but also gives the guiding opinions in the direction of participation. This paper analyzes several provisions that guide social forces to participate in the construction of public libraries by connecting the reality, which include planning support, donation guidance, commendation reward and volunteers service in the bill. The feasible direction of social force participating in the public libraries＇ construction is put forward. This paper also analyzes and points out the problems of the imperfect details of the bill in the aspects of registered nature cognizance of social force, professional competence specification of it, operation management specifications and donation specification and so on.
