摘要
本文结合医疗实务过错的法医学鉴定案例,探讨了死亡类医疗损害侵权案件中鉴定侵权行为(医疗过错行为)、损害后果(死亡原因)二者之间的因果关系,以及侵权行为在损害后果中的责任程度(参与度大小)等问题的基本原则和主要内容。
This paper combines forensic identification cases of medical malpractice, probes into the the causal relationship betweeninfringing act（medical malpractice） and injury consequence（cause of death）in medical tort deathcases, and the basic principles and main content of the problems such as the level of liability of tort in the injury consequence（participation degree）, etc..
