摘要
对于皋陶法刑文化的研究,宜取国家构建与社会转型为视角,揭示和围绕研究对象置身具体的历史情境中触发的问题意识,梳理其法刑话语构建及逐渐形成的历史,探讨关于皋陶作刑、司法的种种比较分散的说法,逐渐汇合成皋陶为中国法刑源祖说的情况;以及宋代"近世"化背景下,朱熹等人对于"明刑弼教"和"桃应难题"等相关话语的重新构建。
It is better to hold the angel of nation's construction and society's change in terms of the culture study ofGao Yao's law and punishment.It exposed and centered the problem consciousness which was triggered by the study subjects in the concrete historical contexts,combed its discourse of law and punishment and its grow up history.It discussed the statements about Gao Yao's thoughts regarding with punishments and laws,and then these thoughts converged the idea of which Gao Yao was the root of Chinese Law and punishment.Moreover,under the background of "Jin Shi"in Song Dynasty,Zhu Xi and other people reconstructed some relevant discourse about"Ming Xing Bi Jiao"and"Tao Ying's difficult problem"and etc.
