摘要
2016年10月,中共中央办公厅、国务院办公厅印发了《关于完善农村土地所有权承包权经营权分置办法的意见》,农村土地"三权分置"工作取得重大进展。"三权分置"背景下,现行土地征收补偿安置制度存在受偿主体部分缺位、农地征收补偿标准低、农地征收安置方式单一等问题。文章基于"三权分置"背景提出将土地经营权主体纳为受偿主体之一,确立对土地经营权主体的农地征收补偿范围;提高对土地承包权主体的补偿水平;以促进现代农业发展和增加农民收入为出发点,增加农业创业安置和"就业+货币"安置两种模式。
The issue of ＂Opinions on the Method of Improving the Division of the Right of Land Ownership, Land Contract and Management＂ in October 2016 by the General Office of the CPC Central Committee and the General Office of the State Council means the right division of rural land has developed vitally. Under this background, the current system of expropriation compensation has the inadequacies of lack of compensation subject,low compensation and mono settlement. It is suggested to include the subject of the land contract and management as one of the compensation subjects. The compensation scope should be determined. The level of com- pensation should be promoted. It is also suggested to add agricultural business and ＂employment ＋ money＂ to the current resettlement system.
