摘要
在刑事拘留未报捕案件中,犯罪嫌疑人被超期羁押的现象十分严重。其原因是由多方面造成的:侦查人员程序正义观念淡薄;刑事拘留缺乏司法控制;相关救济措施的缺失。超期羁押不仅严重侵犯了犯罪嫌疑人的人身自由权,而且降低了诉讼效率,对于案件的公正处理也造成了不良影响。要解决此问题,除了要提升国民程序正义的意识,完善相关救济措施之外,最为核心的是检察院要对被适用刑事拘留措施后的犯罪嫌疑人进行羁押必要性审查。
Extended custody is very common among cases of criminal detention but haven＇t submit for arrest.This consequence is generated with many reasons,such as inquiring officers＇ concept of procedural justice is insufficient;process of criminal detention without judicial control;lack of relevant remedy measures.Extended custody not only infringes suspected offenders＇ personal liberty,but also reduces criminal procedure efficiency.Besides,the case of fair treatment also shadowed in its adverse effects.In order to solve this problem,national consciousness of procedural justice should be affirmed and reforms relevant remedy measures.And,the most important system should be established：public procurator should investigate suspected offenders who enforced the criminal detention,whether it is necessary to carry out his custody.
