摘要
从科学立法的要求可以推知立法质量的两个维度,正当与合理。从合理的维度衡量,公众参与地方立法不一定能够促进立法质量的提高,从逻辑上,参与主体的增加与立法质量的提升并非存在必然的联系。从立法主体的角度看,两类立法活动主体,体制内的专家(官员)与体制外的公众具有不尽相同的理性特点,前者长于目的—工具导向的理性思维,后者在价值理性方面具有优势。如果要实现立法的公益目标,使立法兼具正当性与合理性,就需要根据两类立法主体各自的理性特点进行互补式合作,这样才能最终发挥公众参与的效能和作用。
From the requirements of scientific legislation, we can deduce the two dimensions of legislative quality, which are legality and reasonable. From a reasonable dimension, public participation in local legislation may not necessarily promote the improvement of the quality of legislation. In logic, the increase of the participants is not necessarily related to the improvement of the quality of legislation. From the perspective of the legislative body, the two main types of legislative activities, the experts (officials) of the government and the public have different rational features. The former is good at the purpose-tool-oriented rational thinking and the latter has the value rationality advantage. If legislative goals of public interest are to be achieved and legislation is both justified and justifiable, complementary cooperation needs to be based on the respective rational features of the two types of legislative subjects to ultimately bring about the effectiveness and effect of public participation.
