摘要
"一带一路"合作机制的构建,为建立国际法制新秩序、探索全球法制新范式提供了有利契机。但法律冲突、区域经济合作、生态及环保等一系列法律缺陷同时也成为"一带一路"战略实施面临的新问题。基于国际法视角,从宏观、微观两个层面看,应对"一带一路"合作机制构建法律缺陷的策略应该是:制定相应法律行动计划、建立决策协调与协商谈判法律机制、确立共同行为法律规则;同时,构建"一带一路"法律冲突协调机制、区域经济合作法治保障机制,确立民间组织参与"一带一路"建设的法律地位,推进国内相关立法完善与修改,形成立体、多元的"一带一路"法治化建构体系。
The construction of One Belt One Road cooperation mechanism opens up a new paradigm to explore global legal new path to establish a new international legal order and system; and it gives birth to a fair and efficient public law to provide a favorable opportunity for new products. But the conflict of laws, regional economic cooperation, ecological and environmental protection, non-governmental organizations to participate in the One Belt One Road construction of legal status, domestic legislation cohesion and modify a series of legal defects also become One Belt One Road strategy implementation is facing a new task. This paper, based on the One Belt One Road and International law perspective, from the macro and micro of the two aspects, proposes to actively respond to One Belt One Road cooperation mechanism construction of legal defect strategy： on the one hand, should develop One Belt One Road legal action plan, establish coordination negotiation mechanism, the establishment of legal law the rules of common behavior;, on the other hand, we should establish Belt and Road Initiative legal conflict coordination mechanism of regional economic cooperation, the rule of law, rule of law safeguard mechanism of ecological and environmental cooperation mechanism, establish legal status of non-governmental organizations to participate in Belt and Road construction, promoting the domestic legislation and amendment, the formation of three-dimensional, pluralistic along the construction of legal system.
