摘要
通过对食品安全的国内外治理机制及适用情况进行文献综述评析,就我国食品安全治理存在的内部及与国际贸易中存在的问题进行有效分析。从国际法、日本法、欧盟实践及美国机制方面进行分类对比研究,梳理食品安全法律治理的国际通用标准及制度体系,通过综合利用行政规则、司法规则和私人规则完善我国食品安全治理机制;加强与国际合作提升食品安全能力建设;利用现行食品安全国际法律机制对抗贸易保护主义,最终分析得出为我国建立和完善以公私合作治理理念、预防性控制体系、风险分类为基础的监管制度的食品安全法律治理体系,并为食品安全法律治理提供对比样本和有益借鉴。
Through the literature review and analysis of the domestic and foreign governance mechanism and application of the food safety right, this paper analyzed the problems existing in the internal and international trade of food safety governance. By the classification comparison study from international law, Japanese law, the EU and the United States practice mechanism, this paper combed the international standard and system of food safety legal governance, through the comprehensive utilization of administrative rules, judicial rules and private rules to improve our country's food safety governance mechanism. It's necessary to strengthen international cooperation to improve food safety ability construction. Using the existing international legal mechanism of food safety against trade protectionism. We concluded that we should establish a public-private partnership governance mode, preventive control system, risk classification based on the supervision system of food safety legal system of governance, to provide a useful reference for comparison of samples and the food safety law governance.
