摘要
通过诉事形式、对象、程序、功能等方面的比较可知,中国古代的直诉与当代涉法涉诉信访之间既有外部的差异,也有内在的相似性,相似之根源即古今相类的权力结构。就此而言,直诉即中国古代的涉法涉诉信访。基于此,学界可在涉法涉诉信访改革的视阈下从制度合理性、程序与实体、权力制衡等进路展开对直诉制度的研究。
Through the comparison of the forms,o bjects,procedures and functions of litigation,it can be seen that there are both external differences and internal similarities between the direct appeal in ancient China and the petition visits or letters involving law and litigation nowadays. And the inter-nal similarities root in the similar power structure in ancient and modern China. In this regard,direct appeal can be taken as the petition visits or letters involving law and litigation in ancient China. Hence,the academic circles can deepen the research on the direct appeal system from the perspectives of institutional rationality,procedures and entities,checks and balances of power under the reform of petition visits and letters involving law and litigation.
