摘要
农村土地所有权、承包权和经营权"三权分置"是我国农村土地制度改革的方向。目前,土地股份合作制被视为"三权分置"中"落实所有权"的有效路径。稳定的收益增长机制和完善的集体经济组织是土地股份合作制"落实所有权"的充要条件。以农民集体的组织建设为载体,以集体土地的保值增值为目标,以集体和成员权益的有效实现为归宿,确保所有权的落实,保证农村土地改革的方向不走偏。
The ownership right, contract right and management right of rural land ownership are divided into three parts, which is the direction of rural land system reform in our country. At present, the land share coopera- ＂ ＇ e ＂ rive system is regarded as the effectlv way in the ＂implementation of ownership in three separate rights of rural land. Stable income growth mechanism and perfect collective economic organization are the necessary and sufficient conditions of clarifying the ownership in land stock cooperative system. We should take the collective organization of farmers as the carrier, the value of collective land as the goal, and the realization of collective and members rights and interests in order to ensure the implementation of ownership and to ensure the direction of rural land reform.
