摘要
借助网络通讯技术和支付结算方式的发展,跨境网络赌博犯罪呈现出全新的犯罪态势。根据H省的统计分析和办案经验,跨境网络赌博犯罪呈现出形式多样、手段翻新的状况,网络赌博经营获利者出现地域性转移和技术提供者境外操纵的特点,打击跨境网络犯罪在法律维度、社会维度、司法维度、执法维度四个方面面临着困境。为克服这些困境,我国一方面应借鉴美国和日本规制赌博的先进经验;另一方面应进一步完善立法,加强基础工作、综合治理和协作配合。
There is a freshnew crime situation of cross-border cyber gambling, along with the development of network communication technology and ways of payment and settlement. According to statistic analysis and investigation experience in H province,there are the following characteristics in terms of cross-border cyber gambling crimes. The types and modus operandi are various; profiteers of cyber gambling crimes may transfer from one place to another; technology providers manipulate gambling abroad. Combating of cross-border cyber gambling crimes is trapped into trouble in dimensions of laws,society,judicatureand law enforcement. In order to overcome those difficulties, we shall use advanced experience on gambling management in Japan and U. S. A. for reference on the one hand; further improve legislation and strengthen basic work,comprehensive management and collaboration on the other hand.
